On 27th June 2007, the main high street banks agreed to face the Office of Fair Trading at a test case to determine the fairness or otherwise of default charges. The Financial Services Authority agreed that in the meantime the banks could put all cases on hold.
In April 2008, the judgment was issued. It was good news as the OFT will now be able to consider whether the charges are unfair or not. However, this is only the first stage and the banks may appeal. It's a battle won but there maybe more battles ahead, especially if the banks appeal, so it could take many months to resolve.
We are still able to take on your case but can only register your complaint at the moment. It is important to do this as soon as possible as we will be able to go back 6 years and, assuming the test case is favourable, should also be able to make a claim for future charges.
