House of Lords hearing to start on 22 June 09
A three day hearing has been scheduled at the House of Lords and will begin on 22 June. This means the appeal won’t drag-on until beyond the summer as had been first feared.
On 27th June 2007, the main high street banks agreed to face the Office of Fair Trading (OFT) at a test case to determine the fairness or otherwise of default charges. The Financial Services Authority agreed that in the meantime the banks could suspend all claims for a refund.
In April 2008, the judgment was issued. It was good news as the OFT were told they WILL be able to consider whether the charges are unfair or not. However, the banks appealed and we have been awaiting the outcome of this appeal.
The appeal was heard in November and the verdict was announced on 26th February 2009. The banks lost again. This was another big step in the right direction. However, although it seems the court decided that the banks should not appeal this to the House of Lords they did anyway! Even if this had been the end of this appeal then the OFT still need to decide what level of charges are fair and the banks can even appeal this. Of course we all hope that, particularly in the light of all the recent bad publicity and the latest decision from the High Court, the banks will decide to `throw in the towel' but this seems unlikely.
In the meantime, we are still able to take on your case but can only register your complaint. It is important to do this as soon as possible as we will only be able to go back 6 years from the date of registration. Assuming the test case is favourable, we should also be able to make a claim for charges incurred after the registration date.

Claims for Credit Card charge refunds are unaffected by the test case.
